1. Introduction and Acceptance of Terms

Welcome to Bismuth Records. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Hanan Bismuth, an individual sole proprietor operating under the trade name “Bismuth Records” (“we,””us,””our,” or “Bismuth Records”).

By accessing our website at bismuth-records.com (the “Site”), creating an account, or purchasing any of our products, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must not use our Site or purchase our products.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

2. About Bismuth Records

Bismuth Records is a trade name used by Hanan Bismuth, an individual sole proprietor based in Israel. We specialise in digital music production products, including synthesiser presets, audio plugins, and educational content for music producers.

3. Eligibility

To use our Site and purchase products, you must be at least eighteen (18) years of age. By using our Site and making a purchase, you represent and warrant that you meet this age requirement and have the legal capacity to enter into binding contracts. If you are under eighteen (18) years of age, you may only use the Site and purchase products with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

4. Products and Services

Bismuth Records offers the following categories of digital products:

 

4.1 Serum 2 Preset Packs

Sound design presets compatible with Xfer Records Serum 2 software synthesiser. These presets require a valid, licensed copy of Serum 2 to use. We are not affiliated with Xfer Records, and Serum is a trademark of Xfer Records.

 

4.2 Audio Plugins

Software audio plugins in VST3, AU (Audio Units), and AAX formats, compatible with major digital audio workstations including Ableton Live, Logic Pro, FL Studio, Pro Tools, and others. System requirements are specified on each product page.

 

4.3 Video Courses

Educational video content on mixing, mastering, and music production. Courses are delivered as downloadable MP4 video files.

 

4.4 Supplementary Materials

Some products may include supplementary materials such as project files, PDF guides, preset packs, stems, or sample files. These materials are subject to the same licensing terms as the primary product with which they are included.

All products are subject to change, and availability may vary. We reserve the right to discontinue any product at any time without prior notice.

 

5. License Grant and Usage Rights

Upon successful purchase and payment, we grant you a non-exclusive, non-transferable, perpetual license to use the purchased products subject to the terms and restrictions set forth in this section.

 

5.1 Serum 2 Preset Packs — License Terms

You are granted a royalty-free license to use our presets. This means you may:

  • Use the presets in unlimited personal and commercial music productions
  • Incorporate sounds from the presets into recordings, performances, broadcasts, and synchronisation licenses
  • Modify, tweak, and customise the presets for use in your creative works
  • Use the presets in music you produce for clients (e.g., beatmakers, producers working for artists)

You may NOT:

  • Resell, redistribute, share, or give away the preset files in any form
  • Include the presets in competing preset packs or sound libraries
  • Claim the presets as your own original creation
  • Share your account credentials or download links with others

 

5.2 Audio Plugins — License Terms

You are granted a license to install and use the plugin software on up to two (2) computers that you own or control, provided you are the sole user of the software on those computers.

You may:

  • Install the plugin on up to two (2) computers (e.g., a desktop and a laptop)
  • Use the plugin in unlimited personal and commercial music productions
  • Receive lifetime updates to the plugin at no additional cost

You may NOT:

  • Transfer, resell, or assign your license to another person
  • Share the plugin files, installer, or license key with others
  • Reverse engineer, decompile, or disassemble the plugin software
  • Use the plugin on more than two (2) computers simultaneously

 

5.3 Video Courses — License Terms

You are granted a single-user license to download and view the video course content for your personal educational use.

You may:

  • Download and keep the video files indefinitely
  • Watch the content on any device you own
  • Receive free updates to the course content if and when we release them

You may NOT:

  • Share, redistribute, upload, or stream the video content to others
  • Share your account credentials with others
  • Use the content for public display or commercial training purposes
  • Copy, reproduce, or create derivative works from the video content

 

5.4 General License Restrictions

For all products, you may not share, copy, redistribute, resell, sublicense, or make the products available to any third party in any form. The license is granted to you personally and is not transferable. Violation of these license terms may result in termination of your license and legal action.

 

6. Payment, Taxes, and Order Processing

Our order process is conducted by our online reseller Paddle.com Market Limited (“Paddle”). Paddle is the Merchant of Record for all our orders. This means that when you make a purchase, you are technically purchasing from Paddle, who then licenses the product to you on our behalf.

Paddle is responsible for:

  • Processing all payments securely
  • Calculating and collecting all applicable sales taxes, VAT, and duties based on your location
  • Issuing invoices and receipts
  • Handling payment-related customer service inquiries

By making a purchase, you agree to Paddle’s Checkout Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. All prices are displayed in the currency shown at checkout and include applicable taxes, which will be calculated and displayed before you complete your purchase.

7. Downloads and Product Delivery

Upon successful payment, you will receive:

  • A confirmation email with a download link sent to your registered email address
  • Access to your purchases through your account dashboard on the Site

Download Link Expiry: Download links sent via email are valid for thirty (30) days from the date of purchase. After this period, you may still access your purchases by logging into your account on the Site.

Account Dashboard Access: Your purchased products remain available for download through your account dashboard indefinitely, with no limit on the number of times you may download them. However, we do not guarantee perpetual availability and recommend that you download and back up your purchases promptly.

It is your responsibility to ensure that your system meets the technical requirements specified on each product page before making a purchase. We are not responsible for compatibility issues arising from inadequate hardware, software, or failure to meet stated system requirements.

 

8. Technical Requirements

 

8.1 Serum 2 Presets

Our preset packs require a valid, licensed copy of Xfer Records Serum 2. We do not provide Serum 2 software; you must purchase it separately from Xfer Records. Our presets are not compatible with pirated, cracked, or unauthorised versions of Serum. We cannot provide support for presets used with unlicensed software.

 

8.2 Audio Plugins

Our plugins are provided in the following formats:

  • VST3 (Windows and macOS)
  • AU / Audio Units (macOS)
  • AAX (Pro Tools)

Our plugins are compatible with the latest supported versions of Windows and macOS. Specific system requirements are listed on each product page. We do not guarantee compatibility with all DAWs or system configurations.

 

8.3 Video Courses

Video courses are delivered in MP4 format. You will need a device capable of playing MP4 video files and sufficient storage space to download the course content.

 

9. Refund Policy

We want you to be satisfied with your purchase. Due to the nature of digital products, we offer refunds under the following terms:

 

9.1 Refund Eligibility

You may request a refund within thirty (30) days of your purchase date if:

  • The product is materially different from its description on the Site
  • The product files are corrupted and we are unable to provide working replacement files
  • Technical issues prevent the product from functioning as advertised, and we are unable to resolve them
  • You accidentally purchased the same product twice (duplicate purchase)

 

9.2 Non-Refundable Circumstances

Refunds will not be granted for:

  • Change of mind after downloading the product
  • Failure to read the product description or technical requirements before purchase
  • Incompatibility with pirated, cracked, or unauthorised software
  • User error or lack of technical knowledge
  • Dissatisfaction with the creative or artistic quality of presets or sounds
  • System or hardware incompatibility where requirements were clearly stated

 

9.3 How to Request a Refund

To request a refund, please contact us at info@bismuth-records.com with your order number and a detailed explanation of the issue. We aim to respond to all refund requests within five (5) business days. Approved refunds are typically processed within ten (10) business days through Paddle, our payment processor.

 

9.4 Bundle Purchases

For bundle purchases, refunds apply to the entire bundle only. We do not offer partial refunds for individual items within a bundle.

 

9.5 EU and UK Consumer Rights

If you are a consumer in the European Union, European Economic Area, or United Kingdom, you have the right to withdraw from a distance contract within fourteen (14) days without giving any reason. However, by proceeding with the download of digital content, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the download begins. This is in accordance with Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) and equivalent UK legislation. Your statutory rights as a consumer remain unaffected.

 

10. User Accounts

To purchase products, you must create an account on the Site. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your login credentials confidential and secure
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse our services. Upon termination, your license to use purchased products may be revoked.

 

11. User Reviews

Customers who have purchased a product may submit reviews of that product on the Site. By submitting a review, you agree that:

  • Your review reflects your genuine experience with the product
  • Your review does not contain false, misleading, or defamatory content
  • Your review does not contain offensive, abusive, or inappropriate language
  • Your review does not infringe on any third party’s rights

We reserve the right to remove, edit, or decline to publish any review at our sole discretion, including reviews that violate these guidelines, contain spam, are unrelated to the product, or are otherwise inappropriate.

 

12. Promotions, Discounts, and Pre-Orders

 

12.1 Promotional Offers

We may from time to time offer discount codes, sales, or promotional pricing. Such offers are subject to the following:

  • Promotional offers are valid for the period specified and may be withdrawn at any time
  • Discount codes cannot be combined unless explicitly stated
  • We reserve the right to limit quantities or refuse orders at promotional prices
  • Promotional pricing does not apply retroactively to previous purchases

 

12.2 Pre-Orders

If we offer products for pre-order, the following terms apply:

  • Estimated delivery dates are approximate and not guaranteed
  • The price is locked at the time of pre-order
  • You may request a full refund at any time before the product is delivered
  • Once the product is delivered, the standard refund policy applies

 

13. Intellectual Property

 

13.1 Our Intellectual Property

All content on the Site and within our products, including but not limited to sounds, presets, software, video content, graphics, logos, text, and documentation, are the intellectual property of Bismuth Records (Hanan Bismuth) or our licensors and are protected by copyright, trademark, and other intellectual property laws.

The Bismuth Records name, logo, and associated branding are trademarks of Hanan Bismuth. You may not use our trademarks without prior written permission.

 

13.2 Your Rights in Your Works

When you use our products (presets, plugins, or techniques learned from our courses) in your music productions, you retain full copyright ownership of your finished musical works. We claim no ownership or rights to your creative output.

 

14. Product Updates and Discontinued Products

 

14.1 Updates

We may release updates to our products to fix bugs, improve functionality, or add new features. For audio plugins and video courses, updates are provided free of charge for the lifetime of the product.

 

14.2 Discontinued Products

We reserve the right to discontinue any product at any time. We are not obligated to maintain, update, or provide support for discontinued products. If a product that functioned correctly at the time of purchase later becomes incompatible due to changes in operating systems, third-party software, or other factors beyond our control, we are not obligated to provide a refund or compensation.

 

15. Prohibited Conduct

When using our Site and products, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe on our intellectual property rights or those of others
  • Attempt to reverse engineer, decompile, or disassemble our products
  • Use automated systems (bots, crawlers, scrapers) to access the Site without permission
  • Transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the Site’s operation
  • Create multiple accounts to abuse promotional offers
  • Share your account credentials or download links with others
  • Harass, threaten, or abuse our staff or other users

 

16. Third-Party Software and Services

Our products may be designed for use with third-party software (such as Xfer Serum 2, Ableton Live, FL Studio, Logic Pro, and other digital audio workstations). We are not affiliated with the developers of such software and are not responsible for:

  • The availability, functionality, or performance of third-party software
  • Changes made by third-party software developers that affect compatibility with our products
  • Licensing requirements or costs associated with third-party software

You are solely responsible for obtaining valid licenses for any third-party software required to use our products.

 

17. Privacy and Data Protection

We collect and process personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using our Site and services, you consent to our data practices as described in the Privacy Policy.

The personal data we collect may include your name, email address, billing address, purchase history, and other information necessary to provide our services. Payment information is processed directly by Paddle and is not stored on our servers.

We may use your email address to send you transactional emails (order confirmations, download links, account notifications) and, if you have opted in, marketing communications about new products, updates, and promotions. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email.

If you are located in the European Union, European Economic Area, or United Kingdom, you have rights under the General Data Protection Regulation (GDPR) or UK GDPR, including the right to access, rectify, erase, restrict processing, and port your personal data, as well as the right to object to processing. Please refer to our Privacy Policy for more information on how to exercise these rights.

 

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • OUR PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WE DO NOT WARRANT THAT OUR PRODUCTS WILL MEET YOUR SPECIFIC REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
  • IN NO EVENT SHALL BISMUTH RECORDS (HANAN BISMUTH) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.
  • OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above exclusions or limitations may not apply to you. In such cases, our liability shall be limited to the maximum extent permitted by law.

 

19. Indemnification

You agree to indemnify, defend, and hold harmless Hanan Bismuth (doing business as Bismuth Records) from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use of our Site and products
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your infringement of any third party’s rights

 

20. Dispute Resolution

 

20.1 Informal Resolution

If you have a dispute with Bismuth Records, we encourage you to first contact us at info@bismuth-records.com to attempt an informal resolution. We will make good faith efforts to resolve any dispute within thirty (30) days.

 

20.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions.

 

20.3 Jurisdiction

Any disputes arising out of or relating to these Terms or your use of our Site and products shall be resolved exclusively in the competent courts located in Israel. You consent to the personal jurisdiction of such courts.

 

20.4 EU and UK Consumers

If you are a consumer in the European Union or United Kingdom, you may also be entitled to bring proceedings in your country of residence. EU consumers may have access to the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

 

21. General Provisions

 

21.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hanan Bismuth (doing business as Bismuth Records) regarding your use of the Site and products, and supersede all prior agreements and understandings.

 

21.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

 

21.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by Hanan Bismuth.

 

21.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any third party without restriction.

 

21.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, government actions, or internet service failures.

 

21.6 Survival

Provisions that by their nature should survive termination of these Terms shall survive, including but not limited to intellectual property rights, limitation of liability, indemnification, and dispute resolution provisions.

 

21.7 Headings

The headings in these Terms are for convenience only and shall not affect the interpretation of these Terms.
